I believe an Executive Order could stop it, though it's not exactly something the President is supposed to do...

The supreme court i believe has just declined to hear the case, but anyway
If the supreme court rules on an issue of law, the relevant legislative body can amend, repeal, or pass new legislation that fixes the problem the supreme court had with the law in the first place. For Example in 1991 congress passed a new civil rights act that specifically reversed the decisions in 5 cases the supreme court ruled on. If they rule on a constitutional matter, the only way to change the ramafacations of the decision is to change the constitution. Executive orders can be challended in the courts on the basis that it deviates from curent congressional intent or order are beyond the presidents constitutional powers. |

Well thats the thing Mike...the Supreme Court peopel are warping the constitution by translating it into what they want to hear...sometimes I dislike this country , but I am glad to be living in it LOL

It all comes down to translation. Why do you think we have 10000000000 different religions based off of the "Old Testament" or the rest of the Bible? Because each of those religions interprets it differently. I bet you a hot dog that if you read the entire constitution and then I read it I would find something that I think means one thing and you think means another.

To illustrate Ath's point, i maintain that the 2nd amendment gives the citizens of the defence forces the right to bear arms, not every citizen.
But overall the Supreme Court has done a reasonable job, sure the original meaning as the founding farthers intended may not exist in precedent anymore, but that shws that the supreme court is deciding on the issues put before it and modernising... Also remember that the supreme court is deciding on cases put before them... |

BTW Mike what do you do for a job? Look at US Law books all day? You're a very smart guy. I don't even know that much about US law and I actually live here!

If i were a criminal found with a gun, the last thing id argue is that the 2nd amendment dosent apply to anyone except those in the armed forces. Id be arguing the 2nd amendment alows me to carry that gun....
Edit: Thanks for the kind words, dont read US law books as such, although i have been known to read supreme court opinions, but ive always been interested in Law and politics so have just picked up on things. Last edited by Lakie; 03-26-2005 at 02:31 AM. |
