1. A lot of people don't like to get shot at.
2. People are lazy.
3. Many people are too unpatriotic to serve.
4. You don't know who your enemies are.

them U.S. soldier have their own set of rules to follow, if they break them, they are train in handling prisoner he could have call for a medic and get him to the rear to get info out of him? DA

soldier can not make them self's as low as them

you fight and win don't mean you still can go walk up to them shot them in the head when they are down without a weapon on them any more. you take them in as a prisoner and you must handle them too, meaning you safe guard them and get them any medic help they may need then take them to your company HQ to transfer them to higher up's. we live by a higher standers, we don't go there were the low lifers terrorist do without any rules to live by. if we did then we be no better then they are.

sorry that soldier he getting everything he ask for should known better.

This war was about getting rid of opressive regime and freedom of people of Iraq, even though the imaginary WMD was real reason given at the time. I know war is hell but when one goes to war on a "moral high ground" he must also abide by rules and responsibilities that accompany it. What he did gave bad name to our military and set wrong precedence for other allied soldiers. He was made an example so no one else would go through this kind of practise.

You live with the decision you make. This is no DF game, people's life is at stake here.
very good point DD

U.S. Soldier Convicted of Killing Iraqi Walks Free

Fri Apr 1, 2005 11:41 AM ET

BERLIN (Reuters) - A U.S. army tank company commander convicted of shooting dead a wounded Iraqi walked free from court on Friday, although he was dismissed from the army for what he called a "mercy killing."
Army Captain Rogelio Maynulet had faced up to 10 years in jail after a court martial at a U.S. army base in Wiesbaden, Germany, found him guilty of assault with intent to commit voluntary manslaughter.

"He was sentenced with dismissal from the United States Army ... there will be no confinement time," a military spokesman said.

Prosecutors had pressed for conviction on a more serious charge of assault with intent to commit murder, which carries a maximum 20-year jail sentence.

The shooting occurred last May when U.S. troops were pursuing suspected militiamen supporting Shi'ite cleric Moqtada al-Sadr near the Iraqi city of Najaf, the court was told.

U.S. soldiers fired on a car, wounding the driver and a passenger. Maynulet said he then shot dead the driver to put him out of his misery.

"He was in a state I didn't think was dignified. I had to put him out of his misery," Maynulet said in his defense according to U.S. military's Stars and Stripes magazine.

The jury was shown footage of the shooting filmed by a U.S. surveillance drone.

The mercy killing argument was used by the defense in the cases of two U.S. soldiers who were convicted in December and January of murdering an Iraqi.

The man suffered severe abdominal wounds and burns when U.S. troops attacked a rubbish truck they suspected guerrillas were using.

Staff Sergeant Johnny Horne was sentenced to three years in jail and Staff Sergeant Cardenas Alban to one year over the Iraqi's death.

Local Iraqis said the men on the truck were innocent rubbish collectors.

Still think it is low. I would not have shot him unless he was going for a gun.

They knew the Italians were negotiating, were in the area, and were taking the reporter to nearest airport.
