Wrong or preying on stupidity?

the item has been sold for £56 ok but the item is an Xbox box! the seller has technically done nothing wrong, the auction says 'Nearly Brand New Xbox Console Box, No Instructions' could you scam ppl like this and not care because if they are stupid enough to bid then they deserve it? or is this person scum of the earth?
