Dont think so, if it got to court i reckon the seller would ultimately loose...

Consumer law often isnt that pedantic, if it went before a judge then the sellers motives and intent would come into question, combine that with some fair trading laws and the fact that the seller listed something on ebay that violated ebay policy i reckon the purchaser would have a good chance.

Also the fact it was listed in Computers & Networking > Software > Games & Entertainment > Other when a far more suitable category may have been Ephemera, or Advertising ->Computers or such

Even if they lost that, theyd probably have recourse against ebay and ebay would have recourse against the seller that would not deal only wit the item, but may include damages aswell...
