I believe with consoles you arent actually buying the console, your buying the right to use the console, similar to when you buy windows but regardless there are still copyright issues with hacking up consoles and installing games.
I reckon he got of lightely for what he did, i reckon he should at least have had to pay the RRP of the games he sold back t the developer plus damages....
