Just to clarify, if the CD was
legitimatly bought and paid for and the only other option was to have to pay for a replacement CD. Then I believe it's okay to find a different way to play that bought and payed for game.
If you have ever added a MOD to any game, then the same rule applies.
You paided legitimatly to play, then that game is yours as long as you don't make money from any MODs or CD cracks (piracy included).
