the person do not have the right to resell the game to any one at all i talk to novalogic, inc tech support team, what has to be done is the seller (who sold it to him) have to delete the account at novaworld.com then he can use the Key-code. he best bet is to ask the person who sold it to him, to delete their account totally, so his can use the key-code.
hopefuly they did not get banned, if they did then the key-ocde maybe no longer any good to use or pass-on to others.
other wise if it not use in 90days the account be deleted any ways if not use.
bad thing is DF: Xtreme and JOTR & JOTR:E don't need the cd to play so the seller still can use the game anyways and rip him off.

always try to buy Cdrom games in a store or from a internet store, don't buy use Cdrom games with Key-codes from any other place you asking for trouble. stuck with a game that may not work online at all.
Ebay is for buying use items only, not a good place to get Cdrom programs that use key-codes at all.
