They usually remove all responsiblity for the data on the server, so getting anything from them is probebly going to be pretty imposible, besides the fee you payed. But they might also only give you the symbolic 99% up time. Which makes it hard for you to leagaly get payed back for the loss. 99% means that they will not garantie that the server will be up at all times. I've only had problem once, also a reseller. However I do not blame him as he knew what he was doing and I ended up losing nothing. He was actually switching servers as he had a problem with the former and didn't like it. So I got an upgrade (he just beeing nice, as he had no leagal responsibility to do it) for free and a new linux server with the newest version of CPanel
